Surrogacy is “technically” an in vitro fertilization (IVF) procedure. Such a procedure is possible only in specialized IVF clinics, where all the necessary conditions for its implementation are strictly observed.
To conceive a child, the biomaterial of the genetic parents is used. Donor eggs can also be used in cases of low ovarian reserve in the genetic mother.
A surrogate mother cannot be a genetic mother at the same time, i.e. cannot provide his egg as a donor material. It is this circumstance that fully guarantees that genetically the child will not be in any way connected with the surrogate mother.
The “Surrogacy” program is carried out by surrogacy clinics Georgia according to the following algorithm:
- Choosing a surrogate mother
- Synchronization of menstrual cycles (or in cryopreserved embryo transfer procedure)
- IVF procedure with transfer of embryos and gametes into the uterine cavity of a surrogate mother
A married couple who have resorted to surrogacy in Georgia must be in a registered marriage, and after the birth of the child, the genetic parents become the legal parents of the new-born.
There are two parties involved in a surrogacy agreement:
- The biological mother (genetic), who is the egg donor, and will raise the child, and the biological (genetic) father, who is the sperm donor, and will raise the child – on the one hand.
- A surrogate mother who will carry the child of biological parents, and subsequently undertakes to transfer it to them – on the other. A woman must meet a number of requirements, be healthy physiologically and mentally. The latter is very important, because she will carry someone else’s child for 9 months, and then she will have to pass it on to genetic parents.
If the surrogate mother is married, then the written consent of her spouse is required.
A surrogacy agreement is a document containing all legal aspects of surrogacy and is drawn up on the basis of the legislation of the Russian Federation. It is needed so that in the future there will be no contradictions between the parties.
The agreement includes information about all persons participating in the program.
- The contract is a guarantee of the protection of the interests of all parties.
- The contract specifies all stages of the program:
- The clinic where the IVF protocol will take place,
- The stages of the IVF protocol,
- Where the pregnancy will be carried,
- Where the birth will take place.
- The contract specifies the obligations of each party.
- It is necessary to draw up a separate consent of the surrogate mother to abandon the born child in favour of biological parents.
- The contract (preferably a separate one) contains all the financial information: the amount and timing of payments.
Surrogacy cost in Georgia
Genetic parents are obliged to cover all the costs of not examining the surrogate mother and the ART procedure, pay for all the necessary medical procedures and specialist consultations during pregnancy. They also bear all the costs associated with childbirth and postpartum recovery of the surrogate mother (the recovery period depends on the complexity of childbirth).
It should be understood that surrogate motherhood is a process of enormous responsibility and complexity, not only physical, but also psychological, both for the surrogate mother and for the biological parents of the baby. But, weighing all the pros and cons, we must remember that surrogate motherhood is sometimes the only chance for a childless couple to become happy parents of a healthy baby.
